Confidentiality Statement

California Evidence Code Section 1119 provides that no evidence of anything said or any writing prepared for the purpose of, in the course of, or pursuant to, a mediation is admissable in evidence or subject to discovery, and disclosure cannot be compelled in any arbitration, administrative adjudication, civil action or other noncriminal proceeding. Evidence Code Section 1123 sets forth exceptions to this rule such as when all persons who conduct or otherwise participate in mediation expressly agree in writing to disclosure.

Although parties cannot be prevented from breaching confidentiality, it will be expected that those participating in mediation will honor it.
